1. Acceptance

By creating an account on Clubbie, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the platform. These Terms constitute a legally binding agreement between you and Travis George trading as Clubbie ("we", "us", "our").

2. The Service

Clubbie is a club management platform designed for sports clubs, primarily pickleball clubs. The platform provides tools for session scheduling, bookings, payment tracking, member management, match recording, and club communication.

Clubbie is a platform — we provide the technology, but we are not the organiser of any club, session, or event. Clubs are independently managed by their own administrators and coaches.

3. Eligibility

You must be at least 16 years old to create an account and use Clubbie. By creating an account, you confirm that you meet this age requirement. If we become aware that a user is under 16, we will terminate their account and delete their data.

4. Account Responsibilities

  • Accurate information — You must provide accurate and truthful information when creating your account and maintaining your profile.
  • Password security — You are responsible for keeping your password secure. Do not share your login credentials with anyone.
  • One account per person — Each individual may maintain only one account. Creating multiple accounts is not permitted.
  • Account activity — You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.

5. Acceptable Use

You agree not to use Clubbie to:

  • Harass or abuse — bully, threaten, intimidate, or harass other users
  • Spam — send unsolicited messages, post repetitive or irrelevant content
  • Impersonate — pretend to be another person or misrepresent your identity
  • Engage in illegal activity — use the platform for any purpose that violates applicable laws
  • Disrupt the service — attempt to interfere with, compromise, or disrupt the platform's infrastructure, security, or other users' access
  • Upload harmful content — post content that is offensive, discriminatory, defamatory, or that infringes on others' rights
  • Circumvent controls — attempt to bypass security measures, access restrictions, or rate limits

We reserve the right to suspend or terminate accounts that violate these rules, at our sole discretion.

6. User Content

You may upload content to Clubbie, including photos, comments, reactions, and profile information ("User Content").

  • Ownership — You retain ownership of the content you create and upload.
  • Licence — By uploading content, you grant Clubbie a non-exclusive, worldwide, royalty-free licence to display, distribute, and store your content for the purpose of operating the platform and making it available to other club members.
  • Responsibility — You are solely responsible for the content you upload. Do not upload content that you do not have the right to share, or that violates another person's privacy or intellectual property rights.
  • Community match photos — Photos uploaded to session galleries are shared with the club community. If you delete your account, community match photos you uploaded will remain visible to other club members, but all associated metadata (uploader name, profile link) will be anonymised.

7. Club Administration

Each club on Clubbie is independently managed by its own administrators and coaches. Club admins have management authority within their club, including the ability to:

  • Approve or reject membership requests
  • Assign roles (player, coach, admin)
  • Create and manage sessions
  • View member profiles and booking history
  • Remove members from the club
  • Reconcile payments

Clubbie provides the tools for club management but is not responsible for decisions made by club administrators. Disputes between members and club administrators should be resolved at the club level.

8. Intellectual Property

The Clubbie name, logo, brand identity, platform design, source code, and all associated intellectual property are owned by Travis George trading as Clubbie. You may not reproduce, modify, distribute, or create derivative works from any part of the Clubbie platform without prior written permission.

Nothing in these Terms grants you any right, title, or interest in the Clubbie brand or platform beyond the limited right to use the service as described herein.

9. Disclaimers

Clubbie is provided on an "as is" and "as available" basis. We make no warranties or representations, express or implied, regarding the platform, including but not limited to:

  • That the service will be uninterrupted, error-free, or secure at all times
  • That any defects will be corrected within a specific timeframe
  • That the platform will meet your specific requirements

We do not guarantee the availability of any particular session, court, or club. We are not responsible for the conduct of other users, club administrators, or coaches.

10. Limitation of Liability

To the maximum extent permitted by the laws of Ireland:

  • Clubbie shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform.
  • Clubbie's total aggregate liability for any claims arising from these Terms or your use of the service shall not exceed the amount you have paid to Clubbie in the 12 months preceding the claim, or EUR 50, whichever is greater.
  • Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Irish law.

11. Termination

By you: You may terminate your use of Clubbie at any time by deleting your account from within the app (Profile → Settings → Delete Account). Upon deletion, your personal data will be handled as described in our Privacy Policy.

By us: We may suspend or terminate your account if you violate these Terms, engage in conduct harmful to other users or the platform, or if we are required to do so by law. Where practicable, we will provide notice before termination.

Upon termination, your right to access and use the platform ceases immediately. Provisions that by their nature should survive termination (including Intellectual Property, Disclaimers, and Limitation of Liability) will continue to apply.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.

If you are a consumer resident in the European Union, you also enjoy the protection of any mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of your country of residence.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Send an in-app notification to all active users
  • Send an email notification to your registered email address
  • Update the version number and date at the bottom of this page

Your continued use of Clubbie after notification of changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the platform and delete your account.
